CCIOa

The Colorado Common Interest Act gives HOA's the power to manage, regulate and maintain property that is owned by a group of homeowners in a typically covenant controlled community governed by governing documents that are typically legally binding between the association and the individual homeowners.

Most HOA's are run by 3 or more Board members typically made up of homeowners/"members" of the community.

Most homeowners do not understand their rights and obligations as homeowners to their community/HOA.

Most homeowners will never participate in their HOA,

Most homeowners are unaware of how their HOA works or how the HOA law's work.

-------------------

Most HOA's are run by "professional" management companies.

(I use the word professional loosely)

Most of these "professional" companies know all of these things about homeowners, and they use it to their advantage. After all yhey are in the business of making a profit.

The less homeowners know the less, they will get involved.

The easier they are to control.

Maybe you know what I am talking about?

Below is a PDF of the 2022 Colorado Common Interest Act.

This is the revised 2022, uncertified version with editor notes.

Please always check for the most updated version as these laws can change randomly.

It is broken into 3 sections by page #:

Pages 1-46

pages 47-79

Pages 80-95

Highlighted sections are of special interest.

  • Amending the Declarations -Must read, especially if you own in Millbrook.
  • Meeting - Does your HOA run meetings properly?
  • Homeowner Education - What does your HOA do to educate owners?
  • Association Records - Most association records are viewable including invoice.
  • Construction Defect - This procedure should be used when the association wants to take legal action against a homeowner.

Amending Declarations

If your homeowners association is amending or rewriting the Declarations for your community you should be carefull as to what you let them change.

Homeowners need to communicate with one another and get involved with what's going on in your community.

I have tried to highlight the sections I found worth reading.
